An Ado-Ekiti Customary Court on Thursday dissolved a seven-year old marriage between Esther Adetuyi and her husband, Ajayi Adetuyi, over lack of care.


The News Agency of Nigeria (NAN) reports that the marriage was dissolved on grounds of incompatibility and lack of care for the complainant, Esther, and the only child of the wedlock.

The president of the court, Mrs Olayinka Akomolede, in her judgment observed that the marriage had broken down irretrievably and, consequently, she dissolved it.

She said that since the respondent, Ajayi, had repeatedly shunned the court proceedings, the court deemed it fit to admit the allegations levelled against him.

Akomolede ruled that the custody of the child should be awarded to the complainant while the respondent should be responsible for the child’s education at all levels.

She also ordered that the husband should be paying N5,000 as monthly feeding allowance to the mother for the child.

The president also granted access to the respondent to see his child without fomenting troubles.

Earlier, Esther, a resident of No. 28, Basiri St., Ado-Ekiti, told the court that her husband abandoned her and the child since two years ago and left for Lagos.

She claimed that she had been responsible for his welfare from her meagre monthly salary.

She said the respondent told her to relocate with him but she refused because she could not live with his family in Lagos.

The complainant said that whenever her husband visited Ado-Ekiti, he was always threatening her life that if she did not bring his child, he would deal with her.

She said that whenever she requested for the child’s school fees, he would tell her that he would not pay until she released the child to him.

Esther also alleged that her husband had married another woman in Lagos.

She, therefore, prayed the court to dissolve the marriage and award her the custody of the three-year-old child.
